Terms of Service
Welcome to PrimeTrack Telematics Limited. These Terms of Service (“TOS”) govern your use of our GPS tracking and telematics services. By accessing or using our services, you agree to comply with and be bound by these TOS. Please read them carefully.
1) Service Description: PrimeTrack Rwanda provides GPS tracking and telematics services that enable users to track and monitor vehicles, assets, or individuals through our platform and associated software.
2) User Obligations: By using our services, you represent and warrant that you are legally capable and have the authority to enter into this agreement. You agree to use the services in compliance with applicable laws and regulations in Rwanda, and you will not use the services for any illegal, unauthorized, or fraudulent purposes.
3) User Account: To access and use our services, we provide you appropriate user accounts with rights commensurate to your purchase plan. You are responsible for maintaining the confidentiality of your account information, and you agree to accept responsibility for all activities that occur under your account.
4) Data Privacy and Security: At PrimeTrack Rwanda, we prioritize the privacy and security of your data. Our Privacy Policy explains how we collect, use, and protect your personal information. By using our services, you consent to the collection, use, and disclosure of your information as described in our Privacy Policy.
5) Intellectual Property: Our services and all related software, technology, and content are protected by intellectual property laws. You agree not to copy, modify, distribute, or create derivative works based on our services without our prior written consent.
6) Termination: We may suspend or terminate your access to our services at any time and for any reason, including if you violate these TOS. You may also terminate your account by providing written notice to us.
7) Governing Law and Jurisdiction: These TOS are governed by the laws of Rwanda. Any disputes arising out of or relating to these TOS shall be subject to the exclusive jurisdiction of the courts in Rwanda.
8) Limitations of Liability: Our services are provided on an “as is” and “as available” basis. While we strive to ensure accuracy and reliability, we do not guarantee uninterrupted availability of 3rd party services that our services rely on, such as GSM availability, GPS Satellites, etc. To this extent, you accept that we are not liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or in connection with the use of our services where such 3rd party services fail or are impacted by extraneous factors, or where acts of sabotage are involved that impact our service.
9) Caveat Emptor: Tracking devices serve as valuable aids in monitoring assets, ensuring vehicular safety and gathering telematics data. However, it is imperative to understand that their functionality is dependent upon a number of external factors beyond the control of the tracker hardware.
These factors include: availability/reliability of GSM network signals, availability of GPS satellites in the area, variations in terrain and topography, as well as influence of weather conditions from time to time. Therefore in general, users are advised not to solely rely on trackers in emergency situations or critical data assessments. While trackers play a major role in enhancing security measures and telematics data collection, users may consider having in place alternative emergency measures to augment their tracking devices. This caveat is an industry-wide acknowledgment of the multifaceted dependencies inherent in tracking technology the world over.
10) Entire Agreement: This TOS constitute the entire agreement between you and PrimeTrack Rwanda regarding the use of our services and supersede any prior agreements or understandings.
